LEA Ad-Hoc Advisory Workgroup Publishes December 2015 Meeting Minutes

The LEA Ad-HOc Advisory Workgroup, comprised of LEA representatives, DHCS, and the California Department of Education (CDE), held their regularly scheduled meeting to make recommendations and discuss issues impacting the LEA Medi-Cal Billing Option Program.

Highlights from the December 2, 2015 meeting include:

  • CDE noted that the California State Auditor has completed its audit regarding the use of Assembly Bill 114 funds. The official report is forthcoming.
  • The Department presented a proposal to increase the audit withhold up to a cap of one million dollars (rather than the previously proposed $820,000 cap). LEAs requested that A&I provide supporting documentation for the $1,000,000 budget request (for the 13.5 A&I positions). The $1,000,000 A&I budget cap proposal was accepted by a show of Advisory Workgroup participant hands.
  • DHCS is working with Xerox to compile data needed to calculate the fair share withhold amount for each LEA for FY 2013-14.
  • DHCS submitted Operating Instruction Letter (OIL) 420b-14 to Xerox to reduce the 2.5% A&I/NCI withhold to 1.5%. SNFD expects that even though the withhold amount is being reduced, it will continue to cover expenses, including the increase to $1,000,000 requested by A&I.
  • Policy and Procedure Letter (PPL) 15-024 “Implementation of Telehealth for Speech Therapy Services in the Local Educational Agency Medi-Cal Billing Option Program” was published on December 1, 2015 for July 1, 2016 implementation.
  • SPA 15-021 was successfully submitted to CMS on 9/30/15. CMS must respond by 12/29/15.
  • The LEA Legislative Report will be combined for FYs 2013-14 and 2014-15. Navigant and SNF are working collaboratively to complete and submit the report by 12/31/15.
  • DHCS is in process of provider manual reviews regarding Free Care policy changes, and has notified LEAs of current status of Free Care via e-blast. A Workgroup member asked whether retroactive billing for Free Care and new service providers would be allowable under SPA 15-021. The Department indicated that the State Plan Amendment effective date is 7/1/15, but that CMS would need to approve retroactive billing. DHCS also stated that the 24 services per twelve-month period limitation is still in place for non-IEP services until CMS approves SPA 15-021, and that LEAs should operate under status quo until DHCS provides further guidance.
